How does a waiver of grounds of inadmissibility request work?

In the United States, there are immigrant spouses, friends, or parents of US citizens or legal residents who have been denied a green card. In that sense, there is an option for them with an I-601 denial or approval grounds waiver request.

The most complicated part of the process is getting I-601 approval, though there are several steps after that to entering the country legally.

What are the steps to be followed in requesting a waiver of the reasons for refusal?

The first thing is that the applicant must receive information from the US Embassy in his country of origin. This will be once the waiver has been approved by the United States Citizenship and Immigration Services (USCIS).

This package is usually sent via DHL the day the Consulate receives the USCIS I-601 Approval Notice. Therefore, it indicates that the applicant is doing a new interview at the Consulate.

If you do not receive the package within 30 days, it is recommended to contact the consulate because it usually only takes two or three days after approval.

The applicant can schedule the interview online by simply following the instructions in the package. The process will not be carried out through the National Visa Center and the update of documents will depend on the date of the last consular interview.

Then, the passport containing the visa and a sealed package called the “Immigrant Visa Package” will be sent via DHL. This visa will be valid for entering the United States for four months and when the applicant enters the country, they will present the sealed package.

An officer will stamp the visa and the stamp will be a temporary green card (I-551) valid for one year. In this sense, the actual green card must arrive before the end of the year and the Social Security number will be assigned automatically.
