Bolivia will return irregularly handed lands

“Relevant legal procedures have not been complied with, and you know very well that this situation is in the corresponding stages of the Agricultural Environmental Court,” Gonzalez told the Santa Cruz County media.

He noted that Marinkovic appealed, but his claims “were retracted by their weight, because when the procedures established by law are not followed, those lands must return to the state.”

According to the authority, about 300,000 hectares of Santa Cruz have been usurped by former member of the de facto government Jeanine Anez and other landowners with accelerated measures and without complying with regulations.

At the end of last March, the Executive Director of the National Council of Ilos and Marcas in Kolasuyo (Kunamac) Martin Chakulu informed the press that this organization would file a lawsuit.

He insisted that Marinkovic and other individuals associated with the November 2019 coup against then-President Evo Morales exploited the split in the constitutional order to seize this stretch of land.

Konamak warned that he would demand a follow-up to this process.

At the end of October 2020, a few days before the end of the de facto government, the National Institute for Agrarian Reform (INRA) issued the single actionable address MPENAL 0006124 for the Marinkovic family.

This decision was made under the legal representation of Laguna Corazón Agricultural Company.

However, after the electoral victory of the Movement for Socialism and the Rescue of Democracy, with Louis Ars as president from November 2020, the CEO of the Tierra Foundation, Gonzalo Colque, warned of this fraud.

According to documents found and published by Colque, the conclusive evidence of the land trade is that the Marinkovics originally requested ownership of 21,838 hectares, and the INRA granted them the same extension.

Konamik, which was founded 24 years ago, has submitted a bill to amend the Jurisdiction Demarcation Act, with the aim of achieving hierarchical equality between the original jurisdiction of peasants and others, as stipulated in Article 179 of the Plurinational State Political Constitution.
